Welcome to Arctic Ritual ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at arcticritual.com (the "Site"), as well as any purchases of products or services from us. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and Warranty Policy (collectively, the "Policies"), which are incorporated herein by reference.

If you do not agree to these Terms or the Policies, please do not access or use the Site or place an order. These Terms form a legally binding agreement between you and Arctic Ritual.

  1. Eligibility and User Representations

To use the Site or make a purchase, you represent and warrant that:

  • You are at least 18 years old or have the express consent and supervision of a parent or legal guardian.
  • You have the legal capacity to enter into binding contracts.
  • You will use the Site and our products solely for lawful purposes and in compliance with all applicable Australian laws (including the Australian Consumer Law ("ACL") under the Competition and Consumer Act 2010 (Cth)) and any relevant laws in your jurisdiction.
  • You will not use the Site in any way that violates the rights of others, including intellectual property rights, or for any fraudulent, harmful, or unauthorized activities.

We may, at our sole discretion, refuse to provide services or accept orders from anyone who breaches these representations or the Terms.

We reserve the right to modify, suspend, or discontinue any part of the Site or our services at any time without notice. We also reserve the right to refuse service to any person for any lawful reason.

You agree not to:

We strive to provide accurate descriptions, images, and specifications for our cold plunge tubs and related products. However:

  • Product colours, finishes, dimensions, and details may vary slightly due to differences in device screens, lighting, or manufacturing processes.
  • Images may be illustrative or stock photos and not exact representations.
  • Product features, specifications, and inclusions are subject to change without notice for improvements or other reasons.

Pricing, availability, and product details may be updated at any time without prior notice. We do not guarantee the availability of any product and reserve the right to limit quantities or cancel orders if items are out of stock or unavailable.

  1. Pricing and Payments

  • All prices are in Australian Dollars (AUD) and include any applicable taxes and charges that apply at the time of purchase. If GST becomes applicable in the future, it will be clearly displayed at checkout and on your invoice.

  • Prices exclude shipping, handling, and any applicable duties or customs fees, which will be calculated at checkout.
  • We may change prices at any time without notice, but changes will not affect orders already confirmed.
  • Payment must be made in full at the time of purchase using the secure payment methods available at checkout (e.g., credit/debit cards, PayPal).
  • Your order is not accepted until payment is successfully processed and you receive a confirmation email from us.

We use third-party payment processors (e.g., Shopify Payments), and your payment information is handled in accordance with their terms and our Privacy Policy. We do not store full payment card details.

  1. Orders, Shipping, and Delivery

As a dropshipping business, your order may be fulfilled and shipped directly from our third-party manufacturers or suppliers, which could be located overseas.

  • Order processing and delivery times are estimates only and not guaranteed. Typical timeframes are provided in our Shipping Policy.
  • We are not responsible for delays caused by factors beyond our reasonable control, such as customs processing, carrier delays, weather events, or supply chain issues.
  • Risk of loss and title for products pass to you upon delivery to the carrier.
  • You are responsible for providing accurate shipping information. We are not liable for errors in addresses or failed deliveries due to incorrect details.

  1. Returns, Refunds, and Warranty

Our Returns & Refunds Policy and Warranty Policy detail the processes for returns, exchanges, refunds, and warranties. These Policies form part of these Terms.

Nothing in these Terms excludes, restricts, or modifies your rights under the ACL, including guarantees for acceptable quality, fitness for purpose, and remedies for faulty products. If a product does not meet ACL guarantees, you may be entitled to a repair, replacement, or refund.

  1. Third-Party Services and Links

We may integrate or link to third-party services for functions like payment processing, analytics, marketing, logistics, or social media. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, functionality, or practices of third-party sites or services.

  1. Intellectual Property

All content on the Site—including but not limited to text, images, graphics, logos, trademarks, videos, and layouts—is owned by or licensed to us and protected by Australian and international intellectual property laws (e.g., Copyright Act 1968 (Cth)). You may not use, reproduce, modify, or distribute our content without our prior written consent, except for personal, non-commercial use as permitted by law.

If you submit reviews, photos, or other content to the Site, you grant us a non-exclusive, royalty-free, perpetual license to use, display, and modify it for promotional purposes.

  1. Limitation of Liability and Indemnity

To the fullest extent permitted by law, we (including our directors, employees, agents, and suppliers) are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, products, or services, even if advised of the possibility.

Our total liability for any claim is limited to the amount you paid for the relevant product or service. Where liability cannot be excluded under the ACL, it is limited (at our option) to repairing or replacing the goods, resupplying the services, or refunding the price paid.

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your breach of these Terms, misuse of the Site, or violation of any laws.

  1. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from or related to these Terms or your use of the Site will be subject to the non-exclusive jurisdiction of the courts of Queensland.

  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
  • Entire Agreement: These Terms and the Policies constitute the entire agreement between you and us, superseding any prior agreements.
  • No Waiver: Our failure to enforce any right does not waive that right.
